PAYMENT:
All Sales are Final! If you are the winning bidder, you are responsible for Payment.
All items MUST BE PAID IN FULL within 3 business days of auction close. We accept Credit/Debit Cards, Bank Wire Transfer and Venmo. Be aware of these options before bidding. Certain Auctions we can accept Cash, and Cashiers Check at Auction Location. Hay Auctions are not subject to the 3% credit card transaction fees.
BUYER’S PREMIUM:
A buyer’s premium of up to 10% will be charged on all purchases.
SALES TAX:
All sales are subject to Virginia Sales Tax of 5.3% and or appropriate local/state sales tax laws. If you are Tax Exempt we must have your Tax Exempt Form on file. Please submit the form to us by mail or email. Out of State buyers will be charged Sales Tax regardless.
PICK UP:
Please pay attention to Auction Lot Descriptions as pick up dates and times will be given. These dates and times are when the consignor is available to load out hay. IF THESE DATES AND TIMES DO NOT WORK FOR YOUR SCHEDULE- PLEASE DO NOT BID! Consignor must be notified by Buyer the day before the predetermined time of pick up date you choose. If seller is offering delivery that information will be posted in auction lot description, such as cost per mile and delivery range. Terms of delivery is between buyer and seller and not Virginia Online Hay Auctions.
Hay will not be allowed to be removed from the consignor’s location without being paid IN FULL. Consignors address and Contact information will be available to the Buyer ON THEIR PAID INVOICE. A paid invoice from the Buyer must be shown to Consignor at time of pick up.
WARRANTY:
All hay is sold AS IS/WHERE IS, with NO WARRANTY OF ANY KIND EXPRESSED OR IMPLIED. Virginia Online Hay Auctions and Representatives make every effort in describing the hay accurately as possible by various means. All information regarding the condition of hay is believed accurate but in no way guaranteed. Buyers are encouraged to understand the statement of AS IS/WHERE IS before bidding and understands there will be no recourse against Virginia Online Hay Auctions or its representatives.
The auction company reserves the right to accept bids on behalf of an absentee bidder, the seller, or the company itself. The auction company reserves the right to accept or reject any bid and in all cases of dispute the auction company’s decision shall be final.
Registration to auction is a legal and binding agreement to accept responsibility for payment and to these terms and conditions. If any dispute that cannot be resolved between auction company and bidders and to this agreement and to any controversy or claim arising out of or relating to this contract and/or agreement, or breach thereof, shall be settled by arbitration. All legal proceedings will take place by venue of Augusta County, Virginia.
All bidding will be done online only. All bidders must be registered and place bids online. All bidders must be at least 18 years of age or older. The highest bidder for each lot at the close of auction shall be the buyer, and if any dispute arises as to any bidding the auction company will have the sole discretion to determine the successful bidder, or the disputed lot shall be offered again at the last undisputed bid and will be resold. The auction record kept online will be the official record so used.
You have the sole responsibility for ensuring that any software or equipment you use to access the auction platform are in good working order. Auction company will not have any liability relating to the malfunction of any Bidder software or equipment that results is missed bidding opportunities
Any announcements made by the auction company during the auction which change
or correct the written descriptions on the website will take precedence over anything written or implied.
You agree to indemnify, defend, and hold harmless the Auction Company and its employees, officers, owners, affiliates, agents, and representatives from and against any claims, losses, damages, liabilities, judgments, fees, costs, and expenses, including reasonable legal fees and costs, related to, arising from, or associated with you, your agents or representatives – including, but not limited to, personal injury or property damage caused at any sales site or during removal or transportation of items won at auction. The Auction company is not responsible for any action taken by any seller, bidder, or other third party before, during, or after this auction.
